LAW 10.340/2006 – MARIA DA PENHA LAW: FUNDAMENTALS AND LEGAL AND JURISPRUDENCIAL EVOLUTION

Abstract

This article aims to demonstrate how the serious problem of violence against woman, the result of historical machismo, required specific legislation on the subject here in Brazil and how legislative and jurisprudential evolution with new rules and interpretations over time seek to provide broad effectiveness to the spirit of the Law, which is the full protection of the victim. The STJ has issued several summary statements since the promulgation of the law, giving stricter contours to the Law so that the impunity gap can be closed and also given a pedagogical nature to those who commit crimes against women. Furthermore, statistical numbers are shown that prove how serious the problem is.
